A- GENERAL SERVICE AGREEMENT

This AGREEMENT is valid for services provided over the Internet and consists of the rules determining the terms of use of hosting services between INTERNIC® - INNOIT BELGIUM and natural persons or legal entities. You must fully read the service agreement and the usage terms, which are an integral part of this agreement, before ordering any product through our website. The Service Usage Agreement contains the rules you must comply with. If you do not accept this agreement or any of its terms, please cancel your order process and do not place any orders for products or services.

1. SERVICE PROVIDER AND PARTIES

This agreement is concluded between INTERNIC® - INNOIT BELGIUM (hereinafter referred to as “INTERNIC® - INNOIT BELGIUM”) and customers who purchase services provided by INTERNIC® - INNOIT BELGIUM (hereinafter referred to as “CUSTOMER”).

2. SUBJECT OF THE AGREEMENT

The subject of this agreement is to determine the mutual rights and obligations of the parties in accordance with the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts regarding the sale of the services and products specified below, which the customer has ordered electronically from the website of INTERNIC® - INNOIT BELGIUM. By accepting this agreement, the CUSTOMER acknowledges that they have accepted the provisions of this agreement and the updates that INTERNIC® - INNOIT BELGIUM will make periodically.

3. DURATION OF THE AGREEMENT

This agreement is valid from the date the customer pays for the service ordered and remains in effect throughout the service commitment period. If no commitment period is specified, the agreement is valid for one payment period and continues until the next payment is made.

4. INFORMATION SECURITY AND QUALITY MANAGEMENT

INTERNIC® - INNOIT BELGIUM undertakes to apply TS ISO IEC 27001:2013 Information Security Management Systems, TS EN ISO 9001:2008 Quality Management Systems, and related standards to protect customer information and improve service quality. The TS ISO IEC 27001:2013 Information Security Management System has been established, implemented, operated, and continuously improved within INTERNIC® - INNOIT BELGIUM.

5. SUBJECT PRODUCTS OF THE AGREEMENT

The CUSTOMER acknowledges that they have been informed about the characteristics of the servers, rented servers, virtual servers, hosting, and other services provided by INTERNIC® - INNOIT BELGIUM. The CUSTOMER confirms electronically that they have received all the necessary information about the services before placing an order. The CUSTOMER also confirms that they have been informed about the delivery details and their right of withdrawal.

6. SERVICE DELIVERY, PLACE OF PERFORMANCE, AND DELIVERY METHOD

The ordered service is hosted on the servers allocated to the CUSTOMER at the INTERNIC® - INNOIT BELGIUM data center, and all information related to the service is sent to the registered email address of the CUSTOMER. The CUSTOMER is responsible for the security and confidentiality of access information related to the service.

7. RESPONSIBILITIES OF INTERNIC® - INNOIT BELGIUM

INTERNIC® - INNOIT BELGIUM is obliged to provide the services to the customer for which payment has been made in advance. However, there is no obligation to provide the service if the payment is not made or is canceled. Additionally, once the service access credentials and information are sent to the CUSTOMER, the security of these details is entirely the responsibility of the CUSTOMER.

8. CUSTOMER RESPONSIBILITIES

The CUSTOMER is responsible for securely storing and using the access credentials and information required for accessing the service. The CUSTOMER agrees to use the services provided by INTERNIC® - INNOIT BELGIUM in compliance with the law and not to publish illegal content. Moreover, the CUSTOMER accepts responsibility for any damage that may arise from the misuse of the servers provided by INTERNIC® - INNOIT BELGIUM.

9. FEES, PAYMENT, AND REFUNDS

Based on the offer provided to the CUSTOMER, payment must be made for the service to be activated. After the payment is made, the service is activated. Payments must be made in advance, and the service usage fee must be renewed regularly. Cancellation and refund requests are evaluated in accordance with INTERNIC® - INNOIT BELGIUM’s refund policies. Refunds are made only for unused service periods, and refunds for domain names, SSL certificates, or other third-party products are not provided.

10. TAXATION

All transactions related to the services provided by INTERNIC® - INNOIT BELGIUM are carried out in accordance with the applicable tax regulations in Turkey and Belgium. Any transaction resulting from changes in tax laws will be reflected in this agreement and accepted by both parties.

11. TERMINATION

The CUSTOMER can cancel the service at any time and terminate this agreement. For the cancellation to be valid, it must be made before the renewal period. INTERNIC® - INNOIT BELGIUM also reserves the right to unilaterally terminate the agreement, in which case only the remaining service period’s fee will be refunded to the CUSTOMER.

12. COMPETENT COURTS AND ENFORCEMENT OFFICES

In case of any disputes arising from the application of this agreement, the competent courts and enforcement offices in Quaregnon, Belgium, will have jurisdiction.

13. FORCE MAJEURE

In the event that the parties are unable to fulfill their obligations under the agreement due to force majeure, such as war, civil war, acts of terrorism, earthquakes, fires, floods, or other natural disasters beyond their control, this agreement may be terminated. Either party must notify the other party if a force majeure event occurs.

14. CONFIDENTIALITY AND DATA SECURITY

The CUSTOMER’s personal data will be processed and protected in accordance with the Personal Data Protection Law. The CUSTOMER acknowledges that the information provided is accurate and agrees to the processing of this information. The CUSTOMER is responsible for maintaining the confidentiality of all information obtained during the use of the service and agrees not to share this information with third parties.

15. VALIDITY

By placing an order through the INTERNIC® - INNOIT BELGIUM website, the CUSTOMER is deemed to have accepted all the terms of this agreement. INTERNIC® - INNOIT BELGIUM reserves the right to update and modify this agreement when necessary. The changes will take effect once published on the website, and the CUSTOMER is deemed to have accepted these changes.
